Community Benefit(ish) Programs – Revisiting the Important Legal Aspects

Athletic training arrangements, health fairs, 55+ clubs, and other gifts or discounts – they’re all community benefits and ok to offer, right? Of course, for health care organizations, there’s a regulatory component including beneficiary inducements, civil monetary penalties, and kickback laws. This session will explore legal aspects of offering free or deeply discounted items and services in a variety of contexts. We will review applicable rules, relevant Office of Inspector General (OIG) guidance and Advisory Opinions, and offer practical advice for structuring these types of programs.
Michael W. Chase
Michael W. Chase assists clients with issues including compliance with Federal health care program fraud and abuse laws, contract negotiations, reimbursement matters, clinical research and institutional review board compliance, and governance. His practice also focuses on electronic health records (EHR) technology and issues under HIPAA, HITECH, Promoting Interoperability and other Federal and State data privacy laws. He is a member of the Firm’s Privacy & Data Protection group and has assisted clients in various industries with data breach analysis and response efforts.
Kristin N. Lindgren
Kristin N. Lindgren is a member of the firm’s Health Care practice group. She assists health care entities with all aspects of health care law, including regulatory, compliance, transactional, and HIPAA matters. Prior to joining the firm, she worked in health care administration and became familiar with the inner workings of large health care systems.
